Welcome to FlatChatter. By using our website and services, you agree to these Terms of Service. Please read them carefully.
1. What FlatChatter Is
FlatChatter is a platform where verified tenants can share honest reviews of residential rental properties in the United Kingdom. We host user-generated content. We are not a publisher, and we do not endorse, verify the accuracy of, or take responsibility for any individual review posted on the platform.
2. Eligibility
You must be at least 18 years old to create an account and use FlatChatter. By signing up, you confirm that you are 18 or older.
3. Your Account
When you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. If you believe your account has been compromised, contact us immediately at contact@flatchatter.com.
4. Leaving Reviews
4.1 Genuine experience only
You may only review a property where you have genuinely lived as a tenant. By submitting a review, you confirm that you resided at the property during the dates you specify and that your review reflects your real, personal experience.
4.2 Honesty and accuracy
Reviews must be honest and based on fact. You may express opinions about your experience, but you must not make statements you know to be false. Deliberately misleading or fabricated reviews are prohibited and may expose you to legal liability, including under the Defamation Act 2013.
4.3 What you must not include
Your review must not contain:
- Defamatory statements (claims presented as fact that you know to be untrue)
- The full names or personal details of other tenants, neighbours, or individuals
- Threats, harassment, abuse, or discriminatory language
- Content that is obscene, hateful, or promotes violence
- Advertising, spam, or commercially motivated content
- Confidential information from tenancy agreements or legal proceedings, unless it is already in the public domain
4.4 Anonymous posting
Reviews are anonymous by default. If you choose to post anonymously, your identity will not be disclosed publicly. However, we retain a record of which account submitted each review for moderation and legal compliance purposes.
4.5 One review per tenancy
You may submit one review per property per tenancy period. You may update your review at any time.
5. Content Licence
By submitting a review, you grant FlatChatter a non-exclusive, worldwide, royalty-free, perpetual licence to display, reproduce, and distribute your review content on the platform and in connection with our services (for example, in search engine results or promotional materials). You retain ownership of your content and may request its removal at any time by deleting your review or contacting us.
6. Our Right to Remove Content
We reserve the right to remove, edit, or restrict visibility of any review that, in our reasonable judgment:
- Violates these Terms of Service or our Community Guidelines
- Contains defamatory, abusive, or knowingly false content
- Contains personal information about identifiable individuals
- Has been the subject of a valid legal complaint or takedown request
- Is spam or commercially motivated
We are not obligated to review all content before it is published, and we do not pre-screen reviews.
7. Complaints and Takedown Requests
If you are a landlord, letting agent, property manager, or any other person who believes a review is defamatory, contains inaccurate factual statements, or violates these Terms, you may submit a complaint to contact@flatchatter.com.
Your complaint must include:
- Your full name and contact details
- The specific review you are complaining about (include the URL)
- The specific statements you believe are false or defamatory
- An explanation of why you believe those statements are inaccurate
- Any supporting evidence
We will review complaints in accordance with our obligations under Section 5 of the Defamation Act 2013 and respond within 14 days. We may, at our discretion, remove the review, request clarification from the reviewer, or determine that the review does not violate our Terms.
This process does not constitute legal advice, and we encourage parties to seek independent legal counsel where appropriate.
8. Limitation of Liability
FlatChatter provides a platform for tenant reviews. We do not guarantee the accuracy, completeness, or reliability of any review. You should not rely solely on reviews when making decisions about renting or purchasing property. We recommend conducting your own due diligence, including viewing the property and making independent enquiries.
To the fullest extent permitted by law:
- We are not liable for any loss, damage, or expense arising from your use of the platform or your reliance on any review
- We are not liable for any dispute between a reviewer and a landlord, letting agent, or other party
- We are not liable for any action taken by a third party based on content posted on the platform
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Intellectual Property
The FlatChatter name, logo, design, and underlying software are owned by FlatChatter Ltd. You may not reproduce, copy, or distribute any part of the platform without our written consent, except for the purpose of sharing links to property pages or reviews.
10. Termination
We may suspend or terminate your account at any time if you violate these Terms of Service or our Community Guidelines. You may delete your account at any time by contacting us at contact@flatchatter.com. Upon deletion, your profile and address history will be removed. Published reviews may be retained in anonymised form unless you specifically request their deletion.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform. Your continued use of FlatChatter after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
